If you are convicted of DUI, whether in a trial, a guilty plea or a plea to a lesser charge of negligent driving in the first degree or reckless driving, you will be required to obtain an alcohol evaluation. In short, unless your case is dismissed or you are found not guilty at trial, you will eventually need to obtain have one.

Alcohol evaluation and certified alcohol treatment program options

Depending upon your DUI charges, and the nature of your arrest, you may be eligible to petition the court for a rehabilitation option in lieu of conviction. Upon successful completion of an alcohol evaluation, alcohol treatment program and three years of probation, both the criminal charges and the administrative suspension may be dismissed. Every case is different, and no attorney can ethically make a promise that you will qualify.

During your evaluation, you will spend approximately one hour talking with a state-certified alcohol/drug counselor. You will be asked about your relationship with alcohol and/or drugs. The counselor will be looking for signs of untruthfulness. If it is determined that you, and the state, will benefit by having you complete a certified alcohol treatment program, you may be required to participate, as a condition of your plea bargain. Make no mistake. Not every alcohol treatment program qualifies. It is imperative that you consult with an experienced Washington DUI attorney prior to an evaluation.
