I am attorney Peter J. Peaquin. My law firm is located in Seattle, Washington, where I regularly hear from drivers complaining that they were denied entry into Canada. There are some important things that everyone should be aware of when fighting to defend themselves from a DUI conviction. If you are a regular visitor to Canada, neither of the two factors will be welcome news.

Two things you should know about entry into Canada with a DUI conviction

First, like the U.S., Canadian immigration law is a jumble of complex and complicated statutes and regulations. Even U.S. convictions for alcohol-related driving offenses such as drunk driving or reckless driving can result in getting denied entry into Canada. Whether or not you will be admitted will depend upon comparing the crime in the U.S. with Canadian criminal offenses. If the U.S. offense is comparable to a Canadian offense, you may be denied entry into Canada.. For Washington residents who are accustomed to easily crossing the border for weekend visits, this may come as a surprise, following a DUI conviction.

Second, border officials have been given significant authority regarding who they choose to allow in, and who they deny entry. Although you may the right to challenge the border guard's decision all the way to the Canadian Supreme Court, the simple fact is that you won't be continuing with your travel plans while your appeal is pending.
