As of July, 2007, the state of Washington now can charge drivers with felony DUI if a specific set of circumstances were present at the time of the DUI arrest.

A person may be charged with felony DUI under the following circumstances:

Prior drunk driving convictions: If the driver has a history of four or more DUI convictions within the past 10 years, he or she may be charged with felony DUI.

Other prior convictions: If a driver charged with DUI has any prior convictions for first degree negligent driving, reckless driving, reckless endangerment or similar offenses, the DUI charge may be increased to felony DUI.

Felony vehicular homicide or vehicular assault: A driver may also be charged with felony DUI if the driver has been previously convicted of vehicular homicide or vehicular assault based upon driving under the influence.
